Terms of ServiceTerms of Use, Open-Source Licensing & Sponsorship Conditions
1. Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Trinadh Thatakula (Spectra Apps) ("Developer", "we", "us", or "our"), governing your access to and use of our portfolio website (https://www.trinadhthatakula.com), published mobile applications on Google Play under the developer name Spectra Apps, open-source repositories (including Thor App Manager, Odin, and Asgard UI), and community sponsorship/donation channels.
By accessing our website, downloading our mobile applications, or making a donation/sponsorship contribution via platforms such as Patreon, Buy Me a Coffee, Ko-fi, or GitHub Sponsors, you agree to be bound by these Terms and our Privacy Policy.
2. Open Source Software, FOSS Privacy & "AS IS" Disclaimers
Our open-source projects (including but not limited to Thor App Manager, Odin, and Asgard UI) are made available under their respective open-source licenses (such as Apache License 2.0 or MIT License) hosted on GitHub.
FOSS Zero-Data Policy: For our FOSS projects, we do not collect, transmit, or store any information. For other projects and published Google Play applications, we collect only basic data as demanded by each specific app's functionality. Users are requested to refer to each individual application's In-App Terms of Service and Privacy Policy for granular details.
Certain utilities (e.g., Thor App Manager) require advanced Android privileges (such as Shizuku, Dhizuku, or Root access). You acknowledge that you use advanced system utilities voluntarily and assume full responsibility for your device configuration, system integrity, and data backups.
3. Voluntary Sponsorships, Donations & Tips
We receive voluntary sponsorships, donations, and tips from users and community backers via third-party creator platforms including GitHub Sponsors (Primary), Patreon, Buy Me a Coffee, Ko-fi, and PayPal.
You explicitly acknowledge and agree that:
• All donations and sponsorships are purely voluntary gratuitous contributions intended to support independent open-source research, developer tooling maintenance, and server/infrastructure expenses.
• Sponsorships and donations do not constitute an investment, financial instrument, equity purchase, or contractual fee for tailored software engineering services.
• Any discretionary community perks (such as badge recognition, early experimental preview access, or Discord roles) are provided as informal courtesies and do not alter the non-commercial, voluntary nature of the contribution.
4. Cancellation and Refund Policy (Distinct Policy Section)
In strict compliance with Indian e-commerce and consumer protection regulations (including the Consumer Protection Act, 2019 and the Consumer Protection (E-Commerce) Rules, 2020), we maintain a clear, transparent Cancellation & Refund Policy:
You may cancel recurring monthly sponsorships at any time without fees or penalties directly through your respective platform dashboard or by emailing our support desk. Cancellation halts all future renewals at the conclusion of the active billing cycle.
If an unintended, duplicate, or unauthorized donation occurs due to technical error, please notify our support team within 7 days of the charge. Validated erroneous charges are refunded in full to the original payment method within 5–7 business days.
Purchases processed through Google Play Billing follow Google Play refund guidelines (48-hour automated window) and direct developer assistance within 7 days.
For full step-by-step procedures, dispute escalation, and turnaround timelines, please consult our dedicated Cancellation & Refund Policy Page.
5. Intellectual Property & Brand Rights
Unless otherwise specified in an open-source LICENSE file, all content on this website, logos, brand assets, website design, graphics, custom artwork, and documentation are the exclusive intellectual property of Trinadh Thatakula (Spectra Apps) and are protected under copyright and trademark laws. Open-source code remains licensed under its respective open-source terms.
6. Acceptable Use & Conduct
You agree not to misuse our website or mobile applications. Prohibited activities include attempting to compromise server security, reverse engineering closed-source proprietary components, executing denial-of-service attacks, scraping data in violation of robots.txt directives, or utilizing our software for unlawful activities under applicable state, national, or international laws.
7. Third-Party Services & Payment Processors
Financial transactions, donations, and app distributions are facilitated by trusted third-party providers including GitHub Sponsors, Patreon, Buy Me a Coffee, Ko-fi, PayPal, Google Play, Stripe, and Firebase. We do not store credit card or sensitive banking credentials on our infrastructure. Your interactions with third-party platforms are governed by their respective terms and privacy statements.
8. Limitation of Liability
To the maximum extent permitted by applicable Indian law, Trinadh Thatakula (Spectra Apps) shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, data, device malfunction, or other intangible losses resulting from the use or inability to use our software, services, or websites.
9. Governing Law & Dispute Jurisdiction
These Terms, their interpretation, and any disputes arising out of or related to them or our services shall be governed exclusively by and construed in accordance with the laws of the Republic of India, without regard to conflict of law principles.
The competent courts located in Hyderabad, Telangana, India shall have exclusive jurisdiction over any legal proceedings or claims arising hereunder.
